# Judicial expert opinion

Dr. Thomas M. Friesacher, MSc is a sworn and court-certified expert in Austria for transport, aviation and accident investigation. AeroXpert Investigations supports courts and instructing parties. AeroXpert Consulting does not appear as the expert.

## Where the appointment sits

- In Austrian civil proceedings, as an expert witness within the meaning of section 350 of the Code of Civil Procedure (ZPO).
- In Germany, as an expert witness within the meaning of section 414 ZPO.
- In criminal proceedings, as a private expert and, where the court allows, as a person of special expertise who can assist defence counsel when a court-appointed opinion is tested, including under section 249 of the Code of Criminal Procedure.

The expert can support counsel in questioning a court-appointed expert and can explain findings at a hearing: how the evidence supports each conclusion, and where it does not.
